A notice of discontinued claim is how a plaintiff withdraws a claim under rule 11.1 of the Rules of the Small Claims Court. You can discontinue the whole action, the claim against one defendant, or only part of the claim. The notice must be served on every other party and then filed with the court with proof of service.

Use the names and claim number exactly as they appear on the issued Plaintiff's Claim, Form 7A. If there is more than one plaintiff or defendant, list them on the line, separated by commas.

If only part of the claim, describe the part you are discontinuing

If you discontinue against a defendant, that defendant may be entitled to costs under rule 11.1. Discontinuing is not the same as settling. If you have a settlement, ask whether a consent dismissal better protects you. Voss can review which is right for your matter.
